REQUIRED LANDLORD DISCLOSURES

Commercial

Disclosure (66-7-108) – At the tenant’s request, only if the property is less than 1,500 square feet (SF) for commercial and 5,000 SF for industrial, may the landlord provide information to being in conformity with all local/State fire, plumbing, and electrical codes for the building type.

Residential

Access (66-28-403) – As long as it is stated in the rental contract, the landlord may enter the premises within the last thirty (30) days of the lease term. There must be at least twenty-four (24) hours notice before the landlord may enter the property.

Address of Landlord or Agent (66-28-302) – The lessor must provide the address for official notices to the tenant.

Lead Paint – Federal law that mandates any and all housing units built prior to 1978 to furnish tenants with this document.

SECURITY DEPOSITS

Maximum – There no cap. The landlord may request as much as desired for the deposit at the start of the term.

Returning – The landlord must give back any and all funds to the tenant within thirty (30) days of the tenant vacating or the agreement’s termination date. If the tenant does not provide a forwarding address within sixty (60) days the landlord may keep any and all funds associated with the deposit.
