A sublease agreement is a form that allows a tenant to rent space they have under a written contract with a landlord to someone else, known as the “subtenant” or “sublessee”. The tenant renting the space, known as the “sublessor”, will handle negotiating, reviewing the applicant (with a rental application), and accepting all responsibility for the subtenant. In the event of any eviction action, the tenant would be responsible for removing the subtenant from the premises.

Landlord’s Consent

The tenant is required to obtain permission from the landlord if they do not have the rights to sublet the property. Some landlords, rather than allow the tenant to terminate the lease, prefer to allow subletting in order to remain collecting monthly rent.

Landlord Sublease Consent – Required if the tenant does not have permission to sublet the premises.
