The Oregon standard residential lease agreement is the most common rental contract, one which lasts one (1) year with rent payments made by the tenant on a monthly basis. Landlords are encouraged to screen tenants with the rental application before signing any type of agreement. The information collected through the application helps the landlord determine whether a long-term lease is suitable for the applicant. As with other rental contracts, a security deposit may be collected before officially authorizing a lease agreement.

Laws Chapter 90 (Residential Landlord and Tenant)

Disclosures

  • Carbon Monoxide (§ 90.316) – This form contains information on carbon monoxide detectors. If there is a source of carbon monoxide on the property, the landlord must install testers and provide instructions on how to use the equipment.
  • Flooding (§ 90.228) – If the property is located on the 100-year flood map, the landlord must inform the tenant of this information.
  • Lead-Based Paint – Required if the housing was constructed before 1978. The disclosure will state the current status of lead paint remaining on the premises.
  • Outstanding Notices/Pending Suits (§ 90.310) – If the property has four (4) or fewer residential units then the landlord must inform the tenant of any outstanding notice of default or pending suits to foreclose a mortgage.
  • Recycling (§ 90.318) – Applicable to all multi-family units of more than four (4) units that are located in an Urban Growth Boundary, the landlord must furnish instructions to the tenants on the ways to recycle.
  • Smoking Policy (§ 90.220) – Must be given to every tenant to inform them of the smoking policy (if any).
