Oklahoma Month-to-Month Lease Agreement
The month to month lease agreement for Oklahoma is a special type of real estate contract where the lessee rents space from a property owner/manager one (1) month at a time. As long as no notice is made by either party and the lessee continues to pay on the due date stated in the agreement, the term progresses perpetually.
Although the landlord should understand that they will be exposed to the same eviction laws (see oklaw.org) as a standard one (1) year lease agreement. Therefore the landlord should take careful consideration of which type of individuals to rent the space and always review any person(s) with the rental application.
Under Oklahoma law, Statute 41-111, the landlord and tenant must provide at least thirty (30) days’ notice before the next payment date if they would like to cancel the rental arrangement.
- Flooding – Only to be attached to the agreement if the property has experienced flooding in the last five (5) years.
- Lead-Paint – Only if the premises was built prior to 1978. Must be signed by any and all individuals listed on the lease agreement.
