The North Dakota month-to-month lease agreement is a rental contract for a tenant who wants to lease property with a condition that they, or the landlord, may cancel the agreement with at least thirty (30) days’ notice. If the landlord gives notice to change any part of the terms and conditions, the tenant may terminate the lease within twenty-five (25) days (§ 47-16-15(3)). The landlord should understand that they will have to follow the same process for evicting a monthly tenant as they would a standard lessee with a fixed, one (1) year term. Due to this lengthy eviction process, the landlord should consider having their applicant’s fill out a lease application to verify their employment and income status.

Rent Increase (§ 47-16-07) – For month-to-month leases, the landlord must provide thirty (30) days’ notice before raising the rent. If the lease is a fixed-term contract, the landlord should wait until the expiration of the agreement to implement a rent increase.

Minimum Termination Notice (§ 47-16-15) – Seven (7) days’ notice for a weekly tenancy; one (1) month’s notice for a month-to-month tenancy; one (1) month’s notice for a yearly lease with no predetermined end date.

Disclosures

Lead-Based Paint – As per federal law, a landlord of a housing unit constructed prior to 1978 must hand this document out to the residents to provide information regarding the potential existence of lead paint.

Move-in Checklist – If the landlord collected a security deposit, this form must be issued to the lessee to help protect their deposit from being falsely deducted at the end of the term. Note that the deposit may not be greater than one (1) month’s rent unless the tenant has a pet.
