New Hampshire Month-to-Month Lease Agreement
The New Hampshire month to month rental agreement is sometimes also referred to as a tenancy at will because it allows both parties to create a relationship that does not cancel until notice is issued by one of the parties. Under Statute 540:3, a landlord or tenant may cancel the agreement with at least thirty (30) days’ notice to be made in writing (and further it is recommended that it is sent via Certified Letter with a Returned Receipt for proof). The landlord or tenant may also provide the same amount of notice when it comes to any type of change in the agreement such as raising rent, occupants, etc.
The landlord is advised to screen any and all potential lessee’s with the rental application even though the lease may be cancelled with thirty (30) days’ notice. This is due to the same residential laws that apply to all types of leases, whether they may be short or long term.
Required Landlord Disclosures
Lead Paint – Only required for residences built before 1978. Check with the assessor, building, or any other office in the municipality you reside for this information (See Vision Appraisal).
Moving Checklist – To be completed by the tenant within five (5) days of occupying the property to ensure that any pre-existing damage is not the responsibility of the lessee.
Security Deposit Receipt – Only if the deposit was made on behalf of the tenant in any other payment besides a personal, bank, or government check.
