Fill Now!The Montana standard residential lease agreement is the most popular type of rental contract used by landlords for fixed-term tenancies. The rental period will typically last twelve (12) months but may be for any duration as determined by the landlord. Once a tenant shows interest in a housing unit, the landlord should have the applicant complete a rental application to look up their background and current financial status. If approved, a lease should be drafted and, if applicable, a security deposit transferred from tenant to landlord.

Required Disclosures (5)
Mold Disclosure (§ 70-16-703) – The landlord must acknowledge they have no prior information about any mold existing on the premises.
Lead-Based Paint Disclosure – Disclosure that is required for all residences built before 1978 to give notice to tenants that the paint on the interior may contain this hazardous substance.
Methamphetamine Drug Lab Disclosure (§ 75-10-1305(3)) – If the premises has been used as a meth lab in the past or been contaminated from smoke from the use of methamphetamine, the landlord must disclose if the property has been remediated.
Move-in Checklist (§ 70-25-206) – Must be attached to the lease if the landlord accepts a security deposit.
Landlord/Manager/Agent Identification (§ 70-24-301) – The individual authorized to enter the premises must be named in the lease.
