Michigan SubLease Agreement
The Michigan sublease agreement is a form designated for tenants under a rental contract that allows them to sublet, unless they seek the written permission from the landlord, to essentially “re-rent” the property to someone else. A sublease is typically setup in one (1) of two (2) ways:
- Standard SubLease – The act of a tenant renting the ENTIRE SPACE to someone else in exchange for monthly rent.
- Roommate – The act of a tenant renting SHARED SPACE to someone else in exchange for monthly rent.
Either way that is chosen, the tenant accepting the new tenant, sublessor, will bear the full responsibility for the new tenant’s, sublessee’s, actions during the course of the term. This means that, for example, if the sublessee does not pay rent, the sublessor will be responsible for paying the full amount stated in the master lease (with the landlord) for the payment due. Therefore, it is recommended that the sublessor require a rental application before taking on any type of sub-tenant.
- Lead-Based Paint – Only required if the space was built before 1978.
- Moving Checklist – Documents any prior damage to the property in order to protect the Security Deposit from being falsely deducted.
