If a tenant is seeking housing in the state of Hawaii and is a landlord looking to offer a binding lease that may be terminated with short notice to a hopeful tenant, a month to month (tenancy at will) contract is for you. This document is structured so that it renews at the end of every month unless notice is given by one of the parties, i.e the landlord or tenant.

Like the other lease contracts, it is recommended that the property owner ask the applying tenant(s) to fill-out the rental application designated for Hawaii. Once the application is completed, the landlord will have access to important information such as the applying tenant’s employment, criminal, rental, and credit to ensure the landlord is only accepting trustworthy, honest, and financially stably tenants into the property.

Note: All landlord-tenant laws located in the handbook apply to all short and long term renters (including month to month).

Terminating a Month to Month in Hawaii – Section 521-71

Landlords – Must give forty five (45) days written notice.

Tenants – Must give at least twenty eight (28) days’ notice.
