The Oregon three (3) day notice to quit for the nonpayment of rent is used by landlords when a tenant neglects to pay rent on time. The notice informs the tenant that they have three (3) days to either pay the total amount due or vacate the premises. For week-to-week tenancies, the landlord cannot deliver the notice until the fifth (5th) day of the rental period. For month-to-month tenancies and fixed-term leases, the landlord must wait until the eighth (8th) day to deliver the notice (the initial due date shall be included in the waiting period). Tenants that neither pay rent nor move out after acceptance of the notice may be liable for eviction and legal fees. (THIS 3-DAY NOTICE IS NOT OPERABLE UNTIL OCTOBER 1ST, 2022, SEE NOTE BELOW.)

Temporary Notice Period – Landlords serving a notice to quit for non-payment must give either ten (10) or thirteen (13) days’ notice. If the notice is served on or after the fifth day of the rental period, then the number of days’ notice must be at least thirteen (13). If serving on or after the eighth day of the rental period, then the number of days’ notice must be at least ten (10). When is Rent due? (ORS § 90.220(7)) – Rent payments must be made on the date established by the parties in the lease.
