Popular with college students and financially challenged individuals, this California Sub-lease Agreement will allow the tenant (“sub-lessor) of a property to introduce a sub-tenant, called a “sub-lessee”. This type of agreement splits up the rent between the sub-lessee and the sub-lessor(s). This document legally binds the sub-lessor and the sub-lessee, but does not bind the sub-lessor and the landlord in any financial deal.

As an example, if the sub-lessee does not make a payment, the sub-lessor will have to make the payment to the landlord in full. To help remedy this type of potential problem, the sub-lessor can perform a background check on the sub-lessee to ensure they will make payments on time and be overall trustworthy individuals in the property. The sub-lessor should remember to inform the landlord of the new sub-lessees to ensure any possible confusion is dealt with in advance.
